1. Personal data protection according to the LOPD.
ALADANA 2020 SL, in accordance with current legislation on the protection of personal data, informs that personal data collected through the forms on the website: www.ucharter.es, are included in specific automated files of users of the services of ucharter.es. The collection and automated processing of personal data is intended to maintain the business relationship and carry out tasks of information, training, advice and other activities of the website. This data will only be transferred to entities that are necessary for the sole purpose of fulfilling the aforementioned purpose. ALADANA 2020 SL adopts the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data. The user may exercise their rights of access, opposition, rectification and cancellation recognized in the aforementioned Regulation (EU) at any time. The exercise of these rights can be carried out by the user themselves through email to: lopd@ucharter.es The user states that all data provided by them is true and correct, and agrees to keep it updated, communicating any changes to lopd@ucharter.es.
2. Purpose of the processing of personal data:
ALADANA 2020 SL will process your personal data collected through the Website: www.ucharter.es for the following purposes:
-In case of contracting the goods and services offered through ucharter.es, to maintain the contractual relationship, as well as the management, administration, information, provision, and improvement of the service.
-Sending requested information through the forms available on ucharter.es.
-Sending newsletters, as well as commercial communications of promotions and/or advertising of ucharter.es and the sector. Please note that you can object to the sending of commercial communications by any means and at any time by sending an email to the address indicated above. The fields of these records are mandatory, and it is impossible to carry out the stated purposes if these data are not provided. The personal data provided will be kept as long as the commercial relationship is maintained or until you request its deletion and during the period in which legal responsibilities may arise for the services provided.
3. Legitimacy.
The processing of your data is carried out with the following legal bases that legitimize it:

In cases where the user includes files with personal data on shared hosting servers, ucharter.es is not responsible for the user's non-compliance with the GDPR.
6. Data retention in accordance with LSSI.
ALADANA 2020 SL informs that, as a data hosting service provider and in accordance with the provisions of Law 34/2002 of July 11 on Services of the Information Society and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the essential information to identify the origin of the hosted data and the moment in which the provision of the service began. The retention of this data does not affect the secrecy of communications and may only be used in the context of a criminal investigation or for the safeguarding of public security, making them available to judges and/or courts or the Ministry that requires them. The communication of data to the State Security Forces and Corps shall be made in accordance with the provisions of the regulations on the protection of personal data.
7. Intellectual property rights.
ALADANA 2020 SL is the owner of all copyright, intellectual and industrial property rights, "know-how" and all other rights related to the contents of the website ucharter.es and the services offered therein, as well as the programs necessary for their implementation and related information.
Reproduction, publication, and/or non-strictly private use of the contents, in whole or in part, of the website ucharter.es is not permitted without prior written consent.
8. Intellectual Property of the Software
The user must respect the third-party programs made available by ucharter.es, even if they are free and/or publicly available. ucharter.es has the necessary exploitation and intellectual property rights to the software. The user does not acquire any rights or licenses for the service contracted, or for the software necessary for the provision of the service, nor for the technical information on the service, except for the necessary rights and licenses for the fulfillment of the contracted services and only during the term of the same. For any action that exceeds the fulfillment of the contract, the user will need written authorization from ALADANA 2020 SL, being prohibited for the user to access, modify, view the configuration, structure, and files of the servers owned by ALADANA 2020 SL, assuming civil and criminal liability derived from any incident that could occur in the servers and security systems as a direct consequence of negligent or malicious action on their part.
9. The intellectual property of the hosted content.
The use contrary to the legislation on intellectual property of the services provided by ucharter.es is prohibited, and in particular: • The use that is contrary to Spanish laws or that infringes the rights of third parties. • The publication or transmission of any content that, in the opinion of ucharter.es, is violent, obscene, abusive, illegal, racial, xenophobic, or defamatory. • Cracks, program serial numbers, or any other content that violates the intellectual property rights of third parties. • The collection and/or use of personal data of other users without their express consent or contravening the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. • The use of the domain's email server and email addresses for the sending of unwanted mass mailings. The user is fully responsible for the content of their website, the information transmitted and stored, the hypertext links, third-party claims, and legal actions regarding intellectual property.
10. Third party rights and protection of minors.
The user is responsible for compliance with the laws and regulations in force and the rules related to the operation of the online service, electronic commerce, copyright, maintenance of public order, as well as universal principles of Internet use. The user will indemnify ucharter.es for expenses generated by any claim for which ucharter.es is responsible, including fees and expenses for legal defense, even in the case of a non-definitive judicial decision.
11. Protection of hosted information.
ALADANA 2020 SL makes backups of the contents hosted on its servers, but is not responsible for the accidental loss or deletion of data by users. Similarly, it does not guarantee the total replacement of deleted data by users, as such data may have been deleted and/or modified during the period of time since the last backup. The services offered, except for specific backup services, do not include the replacement of contents stored in the backup copies made by ALADANA 2020 when such loss is attributable to the user. In this case, a fee will be determined according to the complexity and volume of the recovery, always subject to the user's prior acceptance. Data recovery is only included in the service price when the loss of content is due to causes attributable to ALADANA 2020 SL.
12. Commercial communications. In accordance with the LSSI.
ALADANA 2020 SL will not send advertising or promotional communications by email or other equivalent electronic means that have not been previously requested or expressly authorized by the recipients. In the case of users with whom there is a prior contractual relationship, ALADANA 2020 SL is authorized to send commercial communications regarding products or services of ucharter.es that are similar to those initially contracted with the client. In any case, the user, after proving their identity, may request that no further commercial information be sent to them through the Customer Service channels.
